NEC Remove Five Citizen from voting And Right to Stand for Elections

The National Election Committee (NEC) held a public hearing on the morning of July 27, 2023, to address five complaints and cases against the decisions made by the Election Commissions of Kampong Cham, Pailin, and Tbong Khmum. The NEC fined five citizens for inciting voters not to vote, imposing a 10-year penalty.

In Case 001, Plaintiff Leur Meng Hang appealed against Resolution 001 KP/KJ dated 17 July 2023 of the Kampong Cham Provincial Election Commission. This decision imposed a fine of 10 Million Riels, removed the plaintiff's name from the voter list, and disqualified him from standing for election for 10 years.

Case 002 saw Plaintiff Heng Vanboth, representing Mr. Hean Rachana, appealing against Resolution 001 dated 17 July 2023 of the Pailin Provincial Election Commission. The commission fined Khem Monikosal, a male, 15 million Riels, removed his name from the voter list, and disqualified him from voting for 10 years.

Case 003 involved Plaintiff's lawyer Hang Vanboth, representing Mr. Hean Rachana, lodging a complaint against Decision No. 002, dated 17 July 2023, issued by the Pailin Provincial Election Commission. The commission imposed a 10 million Riels fine on Sun Sophea, a female, removed her from the voter list, and disqualified her from standing for election for 10 years.

In Case 004, Plaintiff Yorn Sokhoeun, a teacher, appealed against the decision No. 001, dated 19 July 2023, of the Tbong Khmum Provincial Election Commission. This decision fined him 10 million Riels, removed his name from the voter list, and disenfranchised him for 5 years.

As for Case 005, Plaintiff Touch Chivam, a male born on 12 December 1972 and a lawyer, appealed against the decision No. 001 KP/TK dated 19 July 2023 of the Organizing Committee Voting in Tbong Khmum Province. The commission imposed a fine on Yan Sokhoeun, a male born on March 29, 1982, delisted him from the voter list, and removed his right to vote.

The NEC clarified that all the aforementioned complaints are related to instructions to prevent or incite people not to vote, or for voters to mark or destroy the ballots, which is considered an offense under Article 142 of the new version of the law on amendments to the election law.
